According to the articles 36,37,38,39 and 46 of the law 23-12 of the 18 Mouharem 1445 according to 05 august

2023and the general rules of the public market and the articles 39,40,42 et 44 of the presidential decree Number

15/247 at 16 of December 2015 get of public market rule and of public service delegation, the direction of public

works of wilaya of Bejaia identified under fiscal Number 408015000006082 launches National and International

tender notice,open invitation with minimum capacity requirements relate to:

The national and international tender notice open invitation with minimum capacity requirements, is aimed at

companies with all the human and material resources necessary to carry out tunnel upgrading works in the best

conditions;

Case number (01):Alone company:

Professional capacity :

-Disposed of the certificated of professional qualification and classification in current validity to the

opening date, category eight (VIII) and more, as principal activity «public works». in case of the foreign

companies or companies' group with foreign partner, they must get professional certificate of qualification

and classification equivalent;

-Have realised at least:

\> One project of level stake on the longer communed of tunnel of One Thousand Linear Meters

(1 000,00) during the last fifteen (15) years ago to the bid-opening date, the works of level stake

must have:

\- Upgrading the sealing system;

\- Improved lighting;

\- Upgraded ventilation and smoke extraction system;

\- Upgrading the fire fighting system;

\- Upgrade of CCTV system.

Supported by a certificate of good performance delivered by the Project Owner of administration or

public établissement economic and joint the final reception report, or mentioned the date of definitive

on the certificate good performance for the national enterprises to the law Algerian .in the case of

foreign enterprise and international , it is to join the certificate of good performance , or administrative

certificate good or work attestation executed ,delivered by the Project Owner of administration or public

établissement economic and joint the final reception report, or mentioned the date of definitive on the

certificate good performance or administrative certificate execution or works executed attestations

Or:

\> A project for the supply and installation of safety equipment on a new tunnel with a minimum

length of One Thousand Linear Meters 1,000.00 ml, during the last fifteen (15) years from the

date of opening of the bids, the Safety equipment construction work must include the:

. Supply and installation of safety equipment:

\- Lighting;

\- Ventilation and smoke extraction system;

\- Fire-fighting system;

\- Video surveillance system;

\- All necessary equipment for the control centre.

-Supported by a certificate of good performance delivered by the Project Owner of administration or public

établissement economic and joint the final reception report, or mentioned the date of definitive on the

certificate good performance for the national enterprises to the law Algerian .in the case of foreign

enterprise and international , it is to join the certificate of good performance , or administrative certificate

good or work attestation executed ,delivered by the Project Owner of administration or public

etablissement economic and joint the final reception report, or mentioned the date of definitive on the

certificate good performance or administrative certificate execution or works executed attestations

And

-Having a State Engineer in Public Works or Civil Engineering option route and oeuvre d'art or master ,

with at least Five (05) years of experience as a Tunnel Project Manager, justified by a certificate or work

certificate duly stamped by the employer.

-Having carried out at least one road project with a minimum linear distance of 01 Kms in GB and/or BB

and/or BBME, of a quantity of 10,000 tonnes or more (on alone attestation or different attestations)

during the last fifteen (15) years on the date of opening of the bids, Supported by a certificate of good

performance delivered by the Project Owner of administration or public établissement economic public

and joint the final reception report, or mentioned the date of definitive on the certificate good

performance for the national enterprises to the law Algerian .in the case of foreign enterprise and

international , it is to join the certificate of good performance , or administrative certificate good or work

attestation executed ,delivered by the Project Owner of administration or public établissement economic

and joint the final reception report, or mentioned the date of definitive on the certificate good

performance or administrative certificate execution or works executed attestations or works of attestation

executed.

### Financial capacity:

-Having an average turnover (amount of work carried out justified by balance sheets), equal to or greater

than one (01) Billion Dinars, (the average of the years 2022, 2023 and 2024 or 2023 , 2024 and 2025),

certified by an approved expert or tax authorities and vised by the tax service. In the case of foreign

companies, they must justify an average turnover (amount of work carried out justified by balance sheets)

equal to or greater than Two Billion Dinars equivalent, (the average of the years 2022, 2023 and 2024 or

2023 , 2024 and 2025) certified by an approved expert or the tax services, with legalization of all

documents by the Algerian consular services.

Nota: the bidders be authorised to present one offer for the alone (01) lot or for two (02) lots

\- the attestation relative of the route project inferior to 2000 T is not considered

-the capacity to the under traitant get to the technical offer is prise to the evaluation capacity of the

bidders ,according to the article 57 of December 2015 get of public market rule and of public service

delegation

Case number Two (02): enterprise group:

In the case of a temporary group of companies, the eligibility conditions are as follows:

\- The lead partner must meet criteria Nº01 and Nº02 mentioned in the article II-04 (eligibility

condition) :m!

Professional capacity:

-Disposed of the certificated of professional qualification and classification in current validity to the

opening date, category eight (VIII) and more, as principal activity «public works». in case of the foreign

companies or companies' group with foreign partner, they must get professional certificate of

qualification and classification equivalent intensified by the Algerian consulate .

and

-The member or/and the members of the group must have the certificated of professional qualification

and classification in current validity to the opening date, category Six (VI) and more, as principal activity

«public works». in case of the foreign companies or companies" group with foreign partner, they must get

professional certificate of qualification and classification equivalent intensified by the service of the

consulate Algerian

and

\- The group in his globality must get the criteria :

Technical Capacity:

-Have realised at least:

1-the member of the group be designed as principal responsible (the leader) when get the prevue which will be

of the part. this one is solitaire of the anther's members of the group face to face of the contracting.

2-the responsible, representing alone of the group face to face of the contracting authority will be authorised to

assume the responsibility and get the instruction to the all members of the group.

3-the project exemplary of the accord protocol leant the member of the group will join to the bidder when will be

inentioned the prorate of each member of the group.

The technical offer will include an agreement (or memorandum of understanding) binding the members of the

group for the implementation of the project and appointing a leader, the only one authorized to cover the

documents listed 1,2,3 in article II-10 the technical offer and all the documents making up the financial offer. In

the event that the group's offer is accepted, the agreement binding the various members must be confirmed by a

legal document confirming the constitution of the group before signing the contract (memorandum of

understanding of the group).

In accordance with article 57 of Presidential Decree N º 15/247 of 09/16/2015, regulating public contracts and

public service delegations, any tender or candidate, alone or in a group, may avail himself of the capacities of

other companies.

The during of the preparation of the offer, fixed to (30 days) beginning with the first release of the notice of

invitation to tenders at national BOMOP and national daily. the day and the time of deposit of the offers is fixed

between 8h30 and 13h30 (local time) of the last days of the duration of the preparation of the offer.

The technical and financial offers in the same ways as the candidature back must be submitted in three (03)

separate envelopes and closed introduced in an outer envelope closed and anonymous and bearing the following

\- Apply to: Mr the director of the public works to the wilaya of Bejaia ,05Bulwark of brother

BOUAOUINA -BEJAIA-06000.

-The main envelope will contain three (03) closed envelopes bearing the name and address of the tenderer.

An envelope for the technical offer and an envelope for the financial offer and an envelope for the

application file.

The duration of the preparation of the tenders is fixed to 30 days to the date of the first seem of

present notice call at national daily or at BOMOP and the electronic presses and the electronic

partial of the public works and base of infrastructure at 13h30 mn. if this day coincide with

holiday day or the rest day the duration of the preparation of the tenders have adjourned until

the agreeably working day.

If the outer envelope is not sealed and marked as indicated, the principal will not be responsible

for the misplacement or premature opening of the offer.

The opening of the folds of the technical and financial offers will take place in a public meeting on

the day of submission of tenders at 14h00mn, at the headquarters of the direction of public works
