The National Company of Big Oil Works (ENGTP), presented by the Engineering Directorate issues a national and international open invitation to tender regarding:

Supply of replacement piping/fittings for the fire-protection network

For the project: realization in EPC of the increase in storage capacity, modernization of the fuel depot

The Tender Documents may be withdrawn from the above address, by every interested tenderer, in 21 days utmost, as of the publication of this notice in BAOSEM, upon presentation of 'a nominative commitment on paper with company letterhead to the person authorized to withdraw and proof of payment of a non-refundable amount of:

The two-steps submission method applies to this invitation to tender.

Under the first stage, the technical offers, without any indication of the price related to this invitation to tenders, must be submitted in four separate envelopes contained in the same envelope, at the following address:

No later than 30 days as of the date of publication of this invitation to tender in BAOSEM.

Technical offers are accompanied by an offer guarantee in the form of a bid bond in the amount of:

The bid guarantee for national bidders is issued by a bank under Algerian law.

For foreign tenderers, the bid guarantee must be issued in a convertible foreign currency, equal to the amount indicated above;

The foreign tender's bid guarantee must be issued by a bank under Algerian law, covered by a counter guarantee issued by a first-rate foreign bank.

The bid guarantee is valid for a period of validity of offers of 180 days, with an additional period of 30 calendar days.

The tender guarantee may be submitted to the bid opening committee by the tenderer or his authorized representative on the day of opening of the technical offers;

The tender guarantee must conform to the template included in Section 4.

The tender guarantee of the consortium of companies must be drawn up in the name of all members of the consortium submitting the offer.

The tender guarantee of the unsuccessful tenderer at the end of the technical evaluation is returned immediately after the rejection of his offer.

Except for tenderers classified in second and third position: The tender guarantee of the tenderer not selected for the provisional award of the Contract, and who does not file an appeal, is returned one day after the expiration of the appeal period;

The tender guarantee of the unsuccessful tenderer, who lodges an appeal, is returned upon notification, by the competent Conformity Control Commission to the Contracting Structure, of the decision to reject the appeal.

The guarantee of tenderers classified in second and third position is released, either upon definitive award of the Contract to the successful tender (ranked first), or after award of the Contract to one of them in the event of withdrawal of the provisional  Contract awarding.

The tender guarantee of the accepted tenderer of the Contract is released after the contractual guarantees have been put in place.

The tender guarantee must include the following mention:

Letterhead of the bank issuing the bid bond;

Bank registration number and date;

Signature and griffe by the authorized manager of the bank issuing the bid bond;

Damp stamp of the issuing bank;

Side canceled on reverse

The tender guarantee is put into play by the Contracting Structure:

a) If the bidder withdraws during the bid validity period specified in IS 8;

b) If the bidder who obtained the contract refuses to sign the contract during the validity period of the bids;

c) If the tenderer who obtained the contract does not provide the contractual guarantee within the deadlines and conditions provided for in the DPAO.

SWIFT will not be accepted under any circumstances.

Bidders whose technical offers have been declared compliant will be invited to submit a financial offer.

In addition to the original, the number of copies of the financial offer under the second stage must be provided in two (02) copies on paper and one (01) on electronic media (USB key or CD).

The envelopes, under the second stage, will be opened in the presence of the representative(s) of the bidders who wish to attend the opening session, which will be communicated to them by letter of invitation.

Conditions of eligibility:

Tenderers must meet the qualification criteria to execute the contract based on the following criteria:

Proof of a healthy financial situation with a balanced cash flow allowing it to execute the contract subject to this Call for Tenders;

Experience of the Manufacturer / Supplier in the manufacturing - marketing of the requested Supply, for at least Three (03) contracts of a similar nature and of the same scope, these references must be presented on the tenderer's letterhead with the reference of the appeal file of offers, and with presentation of the related certificates of good execution duly signed by the various clients.

- Equipment complies with regulations, norms and standards in force.

The technical capacity and experience criteria will be used to determine whether the supplier has the capacity to perform the contract satisfactorily.

The tenderer will provide, by client names, professional references for contracts of a similar nature to those described in the consultation documents that the Bidder has successfully completed. Such references will include as a minimum:

The name of the customer;

Locations and periods of services provided;

Certificates of good performance duly signed by the various clients without any indication of price (of the contract in question) failing which, the offer will be rejected).

NB:

The references in points 1 and 2 must be provided in a document bearing the supplier's letterhead and signature.

Technical offers must be accompanied by the regulatory documents listed in the specifications.

And any other information or documents to be provided by bidders, if specified in the DAO. tenderers use, in particular, for this purpose, the corresponding documents and models included in the tender file.

Technical offers must contain the following documents:

The technical offer submission letter, according to the model attached to Section 4;

The declaration to be submitted, according to the model attached to Section 4;

The declaration of probity, according to the model attached to Section 4;

The confidentiality declaration, according to the model attached to Section 4;

The declaration of commitment, according to the model attached to Section 4;

The bid guarantee (deposit) bearing minimum indications and equal to the Amount indicated in the table cited above and according to the model attached to Section 4:

Denominated in Algerian Dinar and issued by a bank under Algerian law for Bidders under Algerian law;

Denominated in a convertible foreign currency and issued by a bank under Algerian law counter-guaranteed by a first-rate foreign bank for Bidders under foreign law;

The general information file and the administrative file, as detailed in points 10 and 11 below;

The technical offer itself, including the relevant documents of the Contract, in particular those highlighting the qualifications of the Bidder, its certifications, its approval, the execution plans and methodology, proposed technical solution and its experience;

The delegation(s) of powers of the signatory(s), and that(s) of the groups, authorizing the signatory(s) of the offer to bind the Bidder;

The commitment to provide the guarantee of the ultimate parent company or majority shareholders, if applicable;

Observations and/or comments on the technical offer in relation to the technical file, if applicable;

Observations and/or comments on the draft contract, if exists;

The draft contract signed and initialed in all its pages;

The authorization(s) of the manufacturer(s);

The DAO bearing, on its last page, the words “read and accepted”;

And any other information or documents to be provided by the Bidders, if specified in the DPAO. For this purpose, Bidders use in particular the corresponding documents and models included in the DAO.

tenderers must accompany their technical offers with the following general information file:

The details of its organization and structure, including for each Member of a group or consortium;

Documents relating to his qualifications in the field of the Contract concerned as well as professional references;

Details of its current and forecast workload plan;

ISO certification or equivalent, company quality plan and/or qualification certificate;

Documents proving the qualifications and experience of key personnel;

Documents proving its financial, technical and production capabilities, necessary to execute the Contract;

Bidders must accompany their technical offers with the following administrative file:

The statutes and the list of the main shareholders or partners, certified by the authorized authorities of their country;

Copy of the extract from the electronic commerce register (the Kbis extract);

The tax situation in Algeria and in the countries hosting their head offices;

The situation with regard to social security organizations in Algeria;

The financial situation of the bidder including the balance sheets and income statements and the reports of the Statutory Auditor for the last three (03) years, and any other financial document required in the DPAO;

History of past and current disputes, if applicable.

The extract from the criminal record for natural persons;

Power of the signatory authorized to act in the name and on behalf of the tenderer and committing the company or enterprise for the execution of the contract which is the subject of this Call for tenders. It must be original, dated and signed by the bidder

Copy of receipt for payment of DAO withdrawal fees.
