SINGLE (01) STAGE PROCESS

The National Company for Major Petroleum Works (E.N.G.T.P); The Central Logistics Directorate, located in Reghaia, P.O. Box 09, Algiers Province, issues a national and international competitive open invitation to tenders regarding the supply of:

ONE (01) 10,000 m² tubular scaffolding with clamps.

The deadline for submitting offers is Forty-Two (42) Days as of the date of publication of this notice on BAOSEM.

Tenderers have Thirty (30) days as of the date of publication of the invitation to tender on BAOSEM to withdraw the tender specifications.

Tenderers have Forty-two (42) days as of the date of publication of the invitation to tender on BAOSEM to prepare their offers.

The single-stage submission procedure applies to this Invitation to Tender.

For this Invitation to Tender, technical offers, without any indication of the contract price, and financial offers must be submitted simultaneously in two separate envelopes contained within a single outer envelope marked " à ne pas ouvrir" to the address above.

The eligibility or pre-selection conditions are:

Qualification Criteria:

The Contracting Authority determines whether the tenderer is qualified to perform the contract based on the following qualification criteria:

- Submission of a letter of commitment for the provision of documents required by Algerian regulations, as specified in the technical specifications template.

- Technical offers must address all points of the specifications and be accompanied by technical brochures from the manufacturer for the proposed equipment;

- Include sales references for the proposed model with the technical offer (any sales reference for a model other than the one offered is irrelevant to the evaluation of the tenderer's technical offer and will be considered incomplete).

- Certificates of successful completion of sales for the proposed model, certifying its reliability, must be issued by at least three (3) clients if the model was not purchased by GTP (equipment that has already been the subject of three commercial contracts with our company and has been fully satisfactory is excluded from this requirement).

- Each professional reference for the proposed model must be issued by the client who has used the same equipment and must include the following information :

Name and address of the client company;

Name of the responsible party, their telephone and fax numbers, and email address

Period of equipment operation in the Oil & Gas sector (specify the site of use)

Specify the type of technical problems encountered during the operation of the same equipment;

Specify that the equipment provided has been operated in the Oil & Gas sector for a minimum period of four (4) years without major technical problems.

- Any technical offer will be rejected if the submitted equipment model does not conform to the technical specifications and requirements of the tender documents.

- Financial Status

The Contracting Authority will review the tenderer's financial statements to ensure that they are in a sound financial position and have sufficient liquidity or a line of credit to fulfill the contract.

List of required documents (content of the technical offer)

The technical offer (without any indication of the contract price, price schedule, or any other reference to rates or prices of the contract in question) must include the following documents, duly completed, initialed, and/or signed:

The delegation(s) of authority of the signatory(ies)

Partner(s), delegations of authority for the Consortia;

The letter of submission of the technical offer, according to the attached template;

The submission bail, according to the attached template and equal to the amount indicated in the tender Documents (must be included in the technical offer envelope):

Denominated in Algerian Dinars and issued by an Algerian bank for Algerian tenderers ;

Denominated in a convertible foreign currency and issued by an Algerian bank, counter-guaranteed by a first-class foreign bank, for foreign tenderers.

The declaration to be signed according to the attached template;

The declaration of integrity, according to the attached template;

The code of ethics duly initialed and approved by the tenderer;

Commitment to provide the guarantee of the ultimate parent company or shareholders;

The general information file and the administrative file as detailed below;

The technical offer itself, as detailed in section 7.2.3; including the relevant Contract documents, in particular those highlighting the tenderers's qualifications, certifications, accreditation, execution plans and methodology, proposed technical solution, and experience;

Observations and/or comments on the technical offer in relation to the technical file, if applicable ;

Comments and proposals on the draft contract, if applicable ;

The confidentiality letter according to the template defined in Section 4;

The manufacturer's authorization(s);

The approved and initialed specifications and draft contract;

The Tender Documents bearing the words "read and accepted" on their last page ; and any other information or documents to be provided by the tenderers. Tenderers shall use, in particular, the corresponding documents and templates included in the Tender Documents for this purpose.

General Information File:

The tenderer's technical and administrative offer must be accompanied by the following documents:

Supporting documents establishing that the tenderer is qualified to perform the Contract if its offer is accepted:

If the tenderer proposes to deliver, in performance of the Contract, Supplies that it manufactures or produces, it must provide documents establishing that it:

Is incorporated in the country where the Supplies are manufactured; providing full details of its structure and organization;

Has manufactured or marketed Supplies similar to those covered by this Tender Document for at least three (3) years;

Has received from an accredited certification body a certificate of conformity to the quality standard [ISO, or equivalent, to be specified] in accordance with the quality certification system ; and is currently valid;

Has the necessary production capacity in terms of material, financial, and human resources; and will provide details of its current and projected workload.

Has already marketed supplies similar to those covered by this tender in one (or two) countries other than that of the manufacturer.

If the tenderer proposes to deliver, under the Contract, Supplies that it does not otherwise manufacture or produce, it must provide documentation demonstrating that it is duly authorized to deliver the Supplies in the Contracting Entity's country by a manufacturer of the Supplies that meets the criteria set forth in paragraph (i) above.

The tenderer must also provide the following additional information and documents:

Financial statements: to enable the Contracting Entity to verify that the tenderer is in a sound financial position and has sufficient liquidity or a line of credit to perform the Contract without cash flow difficulties;

Detailed information on the quality control facilities and services present at the manufacturing/assembly site, and the range of tests performed for the commissioning of the Supplies;

A list of major supply contracts performed. Such references will include, at a minimum :

A brief description of the supplies with their specifications;

The client's name;

The place of use;

Three (3) certificates of satisfactory completion;

Experience in providing after-sales service, operation, and maintenance of equipment in a country other than the country where the equipment is manufactured, ensuring that the equipment has been functioning satisfactorily and reliably for at least four (4) years.

Tenderer’s Administrative File

For Algerian tenderers :

Tenderers must submit their technical offers along with an administrative file, including the following documents:

Company statutes and list of principal shareholders or partners;

Extract from its electronic commercial register;

The identification number

Tax identification number (NIF)

Extract from the tax register with a cleared tax liability. For extracts with outstanding tax liabilities, the tenderer must provide a tax calendar certificate or a legal deferral of payment, issued by the competent tax authority.

Update of tax status in Algeria ;

Status with regard to social security organizations in Algeria ;

Certificate of filing of financial statements, for commercial companies registered with the National Trade Register Center.

History of past and ongoing litigation;

Criminal record extract for natural persons;

Financial statement of the tenderer, including balance sheets, profit and loss statements, and the auditor's reports for the last three years;

Power of attorney of the signatory authorized to act in the name and on behalf of the tenderer and committing the company or business to the performance of the contract covered by these specifications. It must be original, dated, and signed by the tenderer; Professional references with three (3) certificates of satisfactory performance from clients of the same nature as those specified in the tender documents;

Copy of the receipt for payment of the tender specifications withdrawal fee;

For foreign tenderers :

Company statutes and list of principal shareholders or partners, certified by the legal authorities of their country;

Extract from their electronic trade register endorsed by the Chamber of Commerce ;

Certificate of tax residence issued by the tax authorities of their country for tenderers without a permanent establishment in Algeria.

Tax clearance certificate for tenderers with a permanent establishment or who have worked in Algeria. For tax clearance certificates showing outstanding tax debts, the tenderer must provide a tax calendar certificate or a legal deferral of payment, issued by the competent tax authorities.

Certificate of social security contributions for tenderers who have worked in Algeria;

Updated tax status in the countries where their registered offices are located;

Financial statement of the tenderer, including balance sheets, income statements, and the auditor's reports for the last three years;

History of past and current litigation;

Criminal record extract for individuals;

Power of attorney for the signatory authorized to act in the name and on behalf of the tenderer and committing the company or business to the performance of the contract covered by these specifications. This document must be original, dated, and signed by the tenderer;

Professional references with three (3) certificates of satisfactory performance for similar projects covered by the tender documents ;

Copy of the receipt for payment of the tender documents.

The financial offer, submitted simultaneously with the technical offer, must contain the following documents :

The price submission letter, following the template defined in the Tender Documents, completed, initialed on all pages, and signed;

The price breakdown and/or price schedules duly completed by the tenderer;

The power of attorney authorizing the signatory(ies) of the offer to bind the tenderer.

Price offer, according to the attached template.

Technical and financial offers must be accompanied by the required documents listed in the specifications.

Tenderers must meet all eligibility requirements mentioned in the tender documents.

Only the BOG receipt stamp affixed to the envelope will be considered valid.

If the closing date falls on a public holiday and/or a day off, envelopes may be submitted on the next working day.

Technical ofers must be accompanied by a submission bail of One Million Five Hundred Thousand Tunisian Dinars (1,500,000.00 DA) for national tenderers, or Nine Thousand Nine Hundred Euros (9,900.00 €) or the equivalent amount in the submission bail for foreign tenderers. The submission bail must be valid for the same period as the offers themselves, i.e., 120 days plus an additional 30 calendar days. The original submission bail may be submitted at the offer opening session.

The envelopes containing the technical offers will be opened in the presence of the tenderer's representative(s) who wish to attend the public opening session, which will be held at the address above. The date will be communicated in due course.

The envelopes containing the financial offers will be opened and examined in the presence of the tenderers who wish to attend, or their duly appointed representatives, at the opening and examination session for the financial offers, which will take place on the date, at the time, and at the address mentioned in the invitation that will be sent only to the tenderers.

Tenderers whose technical offers are declared compliant with the requirements of the Tender Documents.

Tenderers will remain bound by their offers for a period of One Hundred And Twenty (120) Calendar Days as of the date of opening of the technical offers.
